
Terms and Conditions
This Disclaimer, Terms of Service, and Client Agreement (“Agreement) governs the relationship between Culmination Professional Learning, Inc. (“the Corporation”) and the individual or entity engaging its services (“the Client”).
By scheduling, purchasing, or participating in any services provided by the Corporation or its authorized representatives, the Client expressly acknowledges that they have read, understood, and agree to be bound by this Agreement.
Authorized representatives may include independent contractors or sole proprietors engaged by the Corporation to deliver services on its behalf. This includes, but is not limited to, coaches, facilitators, and trainers (collectively, “Service Providers”).
Nature and Scope of Services
The services provided by the Corporation and its authorized representatives are intended to support the Client’s personal and professional growth. The Client acknowledges that coaching and training are comprehensive processes that may involve exploration of various areas of their life, including work, finances, health, relationships, education, and recreation. The Client agrees that decisions regarding how to address these areas, whether and how to incorporate any insights or teachings, and the implementation of any choices or actions are solely the Client’s responsibility.
The services provided do not constitute legal, financial, medical, psychological, or other regulated professional advice.
No Medical or Mental Health Services
The services offered are not a substitute for professional medical care, mental health care, therapy, counseling, diagnosis, or treatment, and are not intended to diagnose, treat, cure, or prevent any medical, mental health or neurodevelopmental condition. Clients are encouraged to seek advice from qualified, or other licensed, professionals regarding any concerns in those areas.
Client Responsibility
The Client acknowledges that the effectiveness and outcomes of coaching or training depend largely on the Client’s own discernment, effort, engagement, and follow-through. The Client accepts full responsibility for their decisions, actions, and results arising from participation in the services.
Confidentiality and Limits
The Corporation and its Service Providers agree to maintain confidentiality of identifying client information and communications, except where disclosure is required or permitted by applicable law, ethical obligations, court order, or regulatory authority.
If a Service Provider reasonably believes that the Client presents a risk of serious harm to themselves or others, appropriate action may be taken, which may include disclosure of information to relevant professionals, emergency services, or authorities, in accordance with the legal requirements of the jurisdiction in which the services are provided or the Client is located.
No Guarantees or Warranties
The Corporation and its Service Providers make no guarantees or warranties, express or implied, regarding any specific outcomes or results from the services. The Service Providers are committed to providing effective coaching and training services; however, results are not guaranteed and vary based on individual circumstances.
Indemnification
The Client agrees to indemnify and hold harmless the Corporation and its authorized representatives from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to: the Client’s misuse of the services, the Client’s breach of this Agreement, any actions or decisions made by the Client based on the services provided.
Refund Policy
All fees are non-refundable.
Acceptance and Binding Effect
By engaging in the services of the Corporation or its authorized representatives, the Client acknowledges and agrees that this Agreement is legally binding and enforceable to the fullest extent permitted by law, whether agreed to electronically, verbally, or in writing.
